Data usage policy of the Central Statistical Bureau
Preamble
The Central Statistical Bureau in the state of Kuwait is always keen to keep abreast of developments in the interest of work and to enhance cooperation and coordination with other entities as required by the public interest of the state and in accordance with the work program of the government of the state of Kuwait and the implementation of the vision of the state (New Kuwait 2025), and in accordance with the legislation and sound legal, institutional and technical frameworks.
Statistics and Census Law No. 27 of 1967 is the law that regulates the role of the Central Statistical Bureau in the state of Kuwait as the official source of the statistical number. This law aims to provide a comprehensive legal framework for the collection and analysis of statistical data and to provide the information necessary to make government and strategic decisions.
The law states that the Central Statistical Bureau is the Entity responsible for the preparation and implementation of statistical plans, the collection and processing of statistical data and the publication of results. The law also provides for the protection of the confidentiality of statistical data and their non-use for non-statistical purposes.
The law also stipulates the importance of cooperation between governmental and private institutions with the Central Statistical Bureau in providing the necessary statistical data, and that the Central Statistical Bureau should have access to the required statistical data.
In general, the Statistics and Census Law No. 27 of 1967 strengthens the role of the Central Statistical Bureau as an independent entity responsible for collecting and processing statistical data and providing information and statistics related to the economic, social, demographic, environmental and cultural growth in the state of Kuwait. These statistics play an important role in the development of government policies and making economic, social and strategic decisions.
1. Legal status of the Central Statistical Bureau
A- The Central Statistical Bureau was established by virtue of Law No. 27 of 1963 on statistics and census, and the first article considered that the Central Statistical Bureau is the only statistical reference in the country, appendix No. 5.
B- The third article stated that one of the most important competencies of the Central Statistical Bureau is the general census of population and housing and the collection of statistical information in all areas concerned by the decisions issued in this regard.
C- The Article (03), paragraph (4), gives the Central Statistical Bureau the competence to supervise the competent statistical work carried out by all entities in the state, and all entities in the state must provide the Central Statistical Bureau with their full work so that the administration coordinates between them.
D- The purpose of the supervision of the Central Statistical Bureau on all statistical data in the state is set out in Article (03) paragraph (5) and is to unify, coordinate and analyze statistical information ... In order to achieve the goals of economic and social development .... "".
E- Law No. 27 of 1963 obliges the Central Statistical Bureau not to publish any special individual data.
2. The objectives set by law for the Central Statistical Bureau
The establishment of the statistics and Census Law No. 27 of 1963 in the state of Kuwait aims to provide modern and accurate statistical data that assist ministries, government departments, public and private institutions in the process of Planning, Development and rational decision-making. The law seeks to achieve this goal by establishing a Central Statistical Bureau called the " Central Statistical Bureau ", defining its terms of reference, organizing the collection, preparation and dissemination of statistical data, and protecting statistical data from illegal use. Perhaps the most prominent objectives of the statistics and census Law No. 27 of 1963 are the following:
A- The establishment of a single statistical reference in the state, namely the " Central Statistical Bureau ", also included the identification of the features of its organizational structure, and the definition of its competencies, including:
• Conducting the general population and Housing Census.
• Collection of statistical information in all Fields.
• Collecting statistical information about workers, users and employees in the Governmental and private sectors.
• Supervising the work of Statistics carried out by the relevant departments in all ministries, departments, institutions and companies in which the government contributes.
• Unifying statistical information, coordinating and analyzing it, and working through various media agencies to publish and broadcast statistical data and studies in order to achieve the goals of economic and social development so that the publication does not deal with any special individual data.
B- Organizing the processes of collecting, preparing and disseminating statistical data.
C- Protecting statistical data from illegal use and maintaining data confidentiality.
D- Regulate the relationship between the Central Statistical Bureau and data providers and users from ministries, government departments, public institutions, individuals, companies, associations, private institutions and owners of public, craft, professional, commercial and industrial shops.
3. Forms of cooperation between the Central Statistical Bureau and users of statistical data
The Central Statistical Bureau of the state of Kuwait cooperates with users of statistical data in order to improve access to statistical data, improve the quality of statistical data and make it more convenient to use, in addition to ensuring the maximum utilization of statistical data in supporting decision-making and planning for the future in order to achieve the goals of economic and social development in the state of Kuwait through a set of channels and means, including:
A- The electronic portal of the Central Statistical Bureau: the electronic portal of the Central Statistical Bureau provides a wide range of statistical data to users, and can be easily accessed through the statistical website www.csb.gov.kw
B- Statistical publishing: The Central Statistical Bureau publishes a variety of statistical reports and studies, which deal with a wide range of economic, social and political topics.
C- Seminars, workshops, signing cooperation agreements and memorandums of understanding: The Central Statistical Bureau participates in many statistical events held in the state of Kuwait and abroad, such as conferences, seminars and training workshops, in addition to organizing a series of seminars and workshops on statistics, which target users from various government and private entities. In addition to signing cooperation agreements and memorandums of understanding with the relevant bodies for statistical work.
D- Social Networks: The Central Statistical Bureau has accounts on various social networking sites, which it uses to communicate with users and provide them with News and new statistical data.
E- Direct communication with those concerned with the Central Statistical Bureau: The Central Statistical Bureau facilitates the service of Direct communication with users, whether by phone, attending in person, or responding to complaints through the "Tawasul" application, through which they can communicate with the administration to get help in obtaining statistical data or learn more about statistics.
F- Provision of consultations and Technical Support: The Central Statistical Bureau provides statistical consultations to government and private entities, through supervision of conducting specialized qualitative surveys or through assistance in providing statistical data to build strategies and update future trends for beneficiaries.
G- Development of tools and applications to facilitate access to data: development of tools and applications to facilitate the use of Statistical data by users.
4. Privacy, Confidentiality and Data Protection
Law No. (27) of 1963 on statistics and Census has laid down the rules and provisions of confidentiality and stressed them and put adequate safeguards to protect them, as follows:
A- Article (03) paragraph (5) of the law made all private individual data confidential and may not be published.
B- Article (07) made all individual data related to statistics or census confidential may not be published and it is prohibited for third parties to see them or to inform others, whether the third party is an individual, a company or a public or private body, except with the consent of the person concerned, and it is also not allowed to use such data for other than statistical purposes.
C- Article (8) of Law No. (27) of 1963 has rendered all statements irrelevant in relation to the arrangement of financial burdens and cannot be relied upon as evidence in a crime or any legal action or conduct.
D- Article (10) of Law No. 27 of 1963 provides for criminal penalties against anyone who violates the confidentiality of statistical data or discloses an individual statement or a commercial or industrial secret or any work that may cause damage due to the disclosure of data confidentiality. This provision applies to all employees and census and statisticians.
E- Article (11) of Law No. 27 of 1963 also establishes deterrent penalties for those who disrupt data collection, provide incorrect data, or disclose secrets.
5. Usage Permit
The Central Statistical Bureau encourages the use of published statistical data to serve the private and public interest in innovative ways. Where statistical data published on the official website of the Central Statistical Bureau can be downloaded or copied while retaining all copyright notices and other proprietary rights published and uploaded to the content of the site.
6. Disclaimer of liability
Article (8) of Law No. 27 of 1963 has made all data irrelevant with regard to the arrangement of financial burdens and cannot be relied upon as evidence in a crime or any legal action or conduct. Moreover, no statistical statement may be relied upon to arrange any financial burden, but it may be used as evidence against those who provided incorrect information.
Therefore, the Bureau is not responsible under any circumstances for any direct or indirect damages that may arise from the use of data issued by the department, and full responsibility lies with the users in how they use these statistics.
